A user or customer shall be understood to be an Internet user who acquires such status by registering on the Website, using a form to which a user name and password are assigned. 7) Nullity

8) Subject matter of the contract
The purpose of this contract is to regulate the contractual relationship between the provider and the user at the moment the user accepts the purchase during the online contracting process by means of the mechanisms described below.
The contractual purchase and sale relationship involves the delivery, in exchange for a specific price and publicly displayed through the website, of one or more specific products.

Therefore, we only ship and distribute products in the Territory. The use of this website as well as any purchase made on it is considered to be made in Spain, and therefore subject to Spanish laws and regulations in force. The Provider does not accept or deliver orders outside the aforementioned Territory.
All of the above is without prejudice to the fact that we may soon be able to offer these services in the excluded areas, in which case they will be announced in advance on this website.

There is no maximum order.
18) How to extend or cancel my order
To extend an order you can always do so as long as you have not completed the purchase, and you can do so by clicking on the “Continue shopping” button.
To cancel an order the customer has a maximum period of 24 hours to cancel it without cost to the customer.

If the order is in delivery or has been delivered, its return will cost the customer 5% of the amount paid for shipping and handling. If the postage would have been free for exceeding the amount for free shipping will be calculated by the company depending on the kg and destination.
For orders that have already left the facilities of HSC Soluciones personalizadas de Hardware para empresas, S.L. the courier company will be notified and in this case, the amount to be returned to the customer would be full except for the shipping costs.

You can also cancel the order from the user’s profile on asicminergroup.com. To do this, the user must locate the order in your purchase history, provided that the above conditions are met, we will proceed to refund the money by the same means with which you have made the purchase, within 24-48 working days.
19) Shipping costs and methods of shipment and delivery time
Shipping costs will depend on the quantity ordered and the place of delivery, which will be calculated once the order is processed. From 160€ the shipping costs are free of charge.
The method of shipment may be home delivery, without however being informed in the future of the possibility of pick-up at the Provider’s home address.
The order will be shipped to the address you indicated at the time of purchase. The Provider does not guarantee delivery to postal boxes.
20) Delivery time
Between the placement of the order and the date of the first delivery attempt by the carrier at the address indicated in the order, corresponds to the sum of these 2 factors:
- If you live in the peninsula, the delivery time is 24/48 working hours upon receipt of payment, unless the order is placed on a Saturday, Sunday or holiday, in which case the order will be processed the first working day following the day of receipt of payment.
- We cannot guarantee 100% of these delivery times, although we try to meet them whenever possible. In rural towns far from urban centers it is not possible to guarantee delivery in 24/48 hours.

We advise you to verify upon receipt of your package that everything conforms to your order and that the packaging of the package is in perfect condition, then sign with reservations and indicate by hand on the carrier’s delivery note if you found any anomaly upon receipt. The products shipped by the suppliers do not facilitate the process of installation and operation of the products.

22) Value added tax
In accordance with current regulations, all purchases made through the website will be subject to Value Added Tax 21% (VAT).
23) Payment Methods or Methods of Payment
In general, the User may choose the method of payment:

24) General Provisions on the Payment Process
The order of payment given by the User necessarily implies the adhesion to these General Conditions as well as to the particular conditions of the order.
For any payment method chosen by the User, all payments shall be subject to the terms and conditions applicable to the User by the intervening financial institutions or secure payment platforms (e.g. Visa, Mastercard, Iupay, etc.).
Once the payment has been made correctly, the User will receive two informative and confirmation e-mails confirming the essential conditions of the operation:
- Services contracted, and description of the services rendered.
- Products shipped to the address indicated by the User:
The confirmation email will contain the invoice of the product with which the User may, upon receipt of the order, request the warranty from the merchant concerned.

The Provider reserves the right to cancel payments or orders in the event that there are indications of fraudulent transactions by bringing to the attention of the competent authorities any conduct that may be subject to investigation for the prevention of fraud.
25) Return of defective, damaged or incorrect products or exercising the right of withdrawal.

In this sense, it will not be accepted the return of all those products that present some type of manipulation of the protective film of the box or wrapping, otherwise the value of the article will suffer a depreciation of the same one.
In addition, it must be ensured that:
- Has not been used improperly or negligently, has not been handled improperly or recklessly, and has not been subjected to abnormal or harmful conditions.
- Has not been involved in any accident or been damaged while attempting to repair or modify it.
- Has not been used in a manner contrary to that stated by the manufacturer in the Product instructions.
- Has not deteriorated due to natural wear and tear after receipt.
In the event that the product does not meet any of the above requirements, we may decide, at our discretion, not to repair or replace the product or refund the amount paid and/or we may ask you to reimburse the full costs of transportation and servicing, arising at the current standard rates. In order to carry out such reimbursement, we may charge the above mentioned costs to your credit or debit card account or use the payment details provided when placing the Order.
In the event of a defective product, the Provider shall proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, which shall be free of charge for the consumer and user.
In the event that the product or its packaging has been damaged or is not in its original shipping condition, the value of the item will be depreciated.
This provision does not affect consumer rights recognized by current legislation.

Once the return request has been examined and the appropriate verifications have been made, after confirmation via e-mail, we will proceed to pick up the product at the place of delivery.
We will proceed to carefully examine the returned product and will inform you by e-mail within a reasonable period of time whether to return or replace it (if applicable). The return or replacement of the item will be made as soon as possible and, in any case, within 14 calendar days from the date on which we send you an e-mail confirming the return or replacement of the non-conforming item.
The amounts paid for those products that are returned because of a proven defect or defect, will be refunded in full, including delivery costs incurred to deliver the item. The refund will be made in the same payment method used to pay for the purchase.
The rights recognized by the legislation in force remain unaffected.

28) Product warranty
The guarantee of the purchased product is to consume it before the date stated on the package.
In case the customer wants to make a complaint, he/she can do it by e-mail asicminerspain@gmail.com or by telephone indicating the order number. The warranty is void if the product has not been stored according to the instructions on the package.
29) Lender’s rights
- To maintain, modify or suspend its website without prior notice.
- Modify the price of the offers.

30) Limitation of liability
All information provided by the User to the Provider and through the corresponding forms must be truthful. It is the User’s responsibility to keep the data provided to Provider duly updated. In any case, Provider disclaims any liability for damages caused as a result of having provided false, insufficient, inaccurate or incorrect information.
Access to the website does not imply any obligation on the part of the Provider to verify the authenticity, suitability, completeness, accuracy, adequacy and updating of the information provided by the User through the corresponding forms.
The Provider shall not be liable in those cases in which it corresponds to the parents, guardians or legal representatives of underage or disabled Users, to authorize access, provision of personal information or use of the website or the contracting of any products or services provided through the applications or web platform. It shall be the responsibility of the aforementioned parents, guardians or legal representatives to supervise the access and use of the minor or incapacitated to the contracting of products and services provided through asicminergroup.com.
